Visitors or customers [hereinafter referred to as the “User” or “Customer”, as the case may be] accessing online booking and purchase of vehicle services through www.chetak.com , online.chetak.com or associated sub-domains and web pages [hereinafter referred to as the “website” or “platform”] agree that they are above 18 years of age while booking a vehicle or test ride or availing any products and services offered through the website. The users also agree that they possess a valid driving license to avail a test ride or purchase a vehicle for riding.
The website offers features to book and purchase a vehicle online and scheduling a test ride for a vehicle, which by law has minimum age criteria of 18 years. Additional features and services (as offered by “Chetak Technology Limited” (a subsidiary of Bajaj Auto Limited), or “Bajaj Auto Limited” (hereinafter referred to as “CTL”, “BAL”, “Company”) through the website(s)) such as e-KYC, online insurance, online finance, completing the vehicle purchase by making online payment, or any other features and services being or to be offered through website(s) or third party agencies or vendors, by law will have minimum age criteria of 18 years. “Chetak Technology Limited”, “Bajaj Auto Limited” (hereinafter referred to as “CTL”, “BAL”) expects the data provided by the user to be correct and in good faith for the transactions. CTL/BAL is not obligated to verify the accuracy of the data provided by a User through the website. CTL/BAL reserves the right to refuse the offered service/product or terminate the service/transaction at any point of time if any User (old or new) are found to have misrepresented or misused the website or any feature of the website.
User agrees that this website is an online platform to browse products, request for a test ride at a dealership, book a chetak online at a dealership, complete vehicle e-KYC, purchase insurance, opt for financing, make payment for purchase online and associated features, which may be periodically enhanced, amended, corrected to improve customer experience. User warrants that he/she is not disseminating malicious code or deploying bots to the website. The user is responsible for ensuring their browser / operating system is up-to-date and free from viruses.
The User shall be solely responsible for the accuracy, credibility, validity of any information submitted via the website or any documents uploaded via the website. CTL/BAL shall not be responsible for verifying the information submitted or documents uploaded. CTL/BAL shall forward the information to the respective dealership / third party vendors (including but not limited to financier, insurer, payment gateway and other service provider etc) and/or government departments for processing the transactions. Any liability arising out of false information or fake documents shall be the responsibility of the User and the User shall be liable for any loss or damages arising out of the same. Further, the User shall indemnify CTL/BAL or its associated partners against any losses or liabilities incurred by CTL/BAL or its associated partners in the event of such losses or liabilities arising out of any false information / undertaking or fake documents.
CTL/BAL provides a platform for online transactions between customer and dealership through payment gateway partner. All payments that are made through the website goes directly to the respective Dealership as selected by the customer, and not to Chetak Technology Limited / Bajaj Auto Limited. Customer’s Confidential Payment information (such as bank account number/ card number etc) is retained by the payment gateway and not shared with either Dealership or CTL/BAL.
Any ancillary third-party services such as purchase of insurances, proposal and application for loan, survey and installation services, if any, shall be executed by respective third-party agencies/ vendors and not by the dealership. The dealership acts solely as a payment and delivery coordination agency. The dealership’s role is limited to the physical sale of the 2-wheeler vehicle to the customer on the basis of verification of the customer’s documents submitted for purchase and receipt of payment for the transaction.
The Customer shall be free to opt out of any third-party services or to not avail any such third-party services. The Customer may choose to change any third-party service provider at the time of renewal of such service, wherever applicable.
Chetak Technology Limited / Bajaj Auto Limited acts as an OEM (Original Equipment Manufacturer) and is providing the website as a service to make the Dealer-customer experience smoother and easier.
BAL / CTL may choose to partner with marketplaces (such as, Amazon, Flipkart, PayTM, ONDC platform etc.) and/or affiliate partners (such as, Bikewale.com, BikeDekho etc.) for online transactions between customer and dealership for sale of a vehicle, parts, accessories and/or value-added services, as a technology platform provider, between customers and authorized Chetak dealerships. All payments that are made by customers through the partner platform goes directly to the respective Dealership as selected by the customer. Customer’s confidential payment information (such as bank account number/ card number etc.) is retained by the partner and not shared with either Dealership or CTL/BAL.
For booking and payment made on the partner platform shall be governed by their respective policies and terms of use. The cancellation, return and refund policies, as agreed by you, during booking process on the respective partner platform shall apply.
While we take utmost care to provide most accurate information to our users on the website, CTL/BAL does not warrant that product / vehicle names, description, prices, images or other content of the website is accurate, complete, reliable, updated, or error-free and assumes no liability in this regard. The vehicle ex-showroom price, on road price details, any special schemes / discounts mentioned on website, e-showroom, price quotation, in-store device or any other information mentioned in digital or physical platforms, are applicable as-on-that date and subject to change without any prior notice. The user shall validate the exact product specifications and associated information by visiting the selected dealership in person.

Chetak Technology Limited / Bajaj Auto Limited, provides a platform for customers to view products, request for a test ride, book and purchase a product online, register for pre-booking, register their interest and associated features, which may get enhanced and amended regularly for improved customer experience and for removal of any defects from time to time.
It is mandatory to provide One Time Password (OTP) verified mobile number and OTP verified email address while making online booking or accessing other services (such as pre-booking or registering their interest). Verified mobile number and email ID are required for important communication from CTL/BAL, your selected dealership and our authorised third-party partners such as insurance and finance services that you may choose to avail of.
While booking online, it is mandatory for a customer to agree to provide acceptable documents as identity proof and local address proof pertaining to the selected city for the purpose of RTO registration. If the customer fails to provide acceptable identity and address proof documents, the customer shall be intimated by the dealership and the dealership may cancel the booking. In the event of cancellation, the cancellation charges as displayed on cancellation page shall be applicable.
While registering for pre-booking online, it is mandatory for a customer to agree to provide acceptable documents as identity proof and driving license for the purpose of registration for test ride. If the customer fails to provide acceptable documents, the dealership reserves the right to disallow access to test ride or priority booking.
Booking shall be deemed as made/ effective only upon receipt of specified booking amount paid by the customer through the online payment mode.
During online booking, if booking amount is deducted by the customer’s issuer bank but it is not received by the payment service provider, customer’s booking shall remain pending until the payment is received. Failure to receive the payment will result into cancellation of pending booking and if any money is deducted from the customer’s account, it would get refunded in 7 working days through the same mode of payment used during booking. In such cases, customers can book a vehicle online again or visit dealership physically.
On request of dealership or CTL/BAL, customer shall produce the booking details sent to their email address and mobile number registered on the website for the purpose of processing the booking.
The Payment of the booking amount for a vehicle, and the final amount (comprising of any third-party services availed by the customer online) shall be made via the selected Payment Gateway. There might be additional payment(towards offline purchases or any differential amount during the final invoice) to be made directly by the customer to the dealership, as applicable. The amount for the selected vehicle would be displayed in the product details prior to making online payment.
The payments made by customers for online booking are credited by payment gateway service provider to the selected dealership directly, after deducting gateway charges and applicable taxes.
The payments made by the customers for online booking are adjusted in final nett amount of the vehicle at the time of making final payment to the selected dealership.
The Payment Gateway shall have discretion to charge a specified fee for this service and CTL/BAL or its dealership holds no responsibility for any such charges levied by the Payment Gateway.
While booking a vehicle online, if money is deducted from customer’s account and booking is not confirmed due to any technical or unforeseen reasons, the money deducted shall usually get refunded within 7 working days in same mode of payment used during booking. If the refund is not processed by the issuer bank, customer shall be required to follow up with their bank directly with the payment details shared through email by the payment gateway partner.
CTL/BAL, dealerships and its partner service providers do not receive and shall not store the payment details including debit/credit card details or net banking details of the customer submitted through the payment gateway provided on the website.
Customer shall be allowed to change a booked vehicle to any other vehicle, as available, within the same dealership where they made the original booking. Customer can change a booked vehicle only until they make final nett payment to the dealership.
When the final nett payment has been made by the customer to the selected dealership, either online or physically at dealership, no modification / change in the booked vehicle shall be permitted.
In case the booking amount for a changed vehicle is higher than the originally booked vehicle, customer shall be required to make the additional payment online, i.e. the positive difference between the booking amount of new vehicle and already booked vehicle, to confirm the modification of the booking.
Only upon receipt of the additional payment by the selected dealership and upon e-mail confirmation of the modification of the booking to the customer, the original booking shall stand amended.
In case the booking amount for a changed vehicle is lower than the originally booked vehicle, the difference amount shall be adjusted by the selected dealership at the time of final nett payment.
Customers can cancel a vehicle booked until they make final nett payment to the dealership. When the final nett payment has been made by the customer to the selected dealership, either online or physically at dealership, no cancellation shall be permitted.
Customers shall complete the purchase journey and take a delivery of a vehicle within 60 days from the date of booking. Failure to make complete payment within 60 days shall lead to booking cancellation. Chetak Technology Ltd./Bajaj Auto Ltd. and its dealerships reserve the right to cancel booking at any point, without any prior notice to the customers.
On cancellation of a successful booking, a cancellation charge shall be levied. The cancellation charge would depend on the selected vehicle and would be displayed at the time of booking as well as during cancellation of a booking. Chetak Technology Ltd./Bajaj Auto Ltd. and its dealerships reserves the right to revise the cancellation charges without prior notice or communication.
Booking cancellations made within 60 days from the date of booking, would get auto refunded through the online system in same mode of payment used for booking after deduction of applicable cancellation charges.
In the event of booking cancellation within 60 days from the date of booking, the refund is usually processed within 7 working days by the issuer bank in the same mode of payment as used while making a booking. If the refund is not processed by the issuer bank, customer shall follow up with their bank directly with the details shared through email by the payment gateway partner.If the customer seeks to cancel the booking after 60 days from the date of booking, refund shall be manually processed by the dealership and customer shall be required to follow up directly with the selected dealership at which the Booking was made. In such situation, refund shall be given manually by the Dealership and shall not be processed through the online system or under the terms and conditions herein, save and except for cancellation charges.
It is mandatory for customers to submit KYC and other associated documents online. After uploading the KYC document online, customer shall be required to visit dealership for inspection and verification of original documents required for vehicle registration, subsidy, as applicable.
The same may be required for loan approval or other third-party services/products availed. While making an online booking, customer provides a consent to Chetak Technology Ltd./Bajaj Auto Ltd. or its dealerships reserves the right to share KYC details / other required documents to the financiers or third-party service providers through digital platform or physical, as required.
Test rides may be available to schedule online at select dealerships for the convenience of the customer. The test ride so scheduled is not a contractual commitment and the dealership may at its sole discretion decide to deny or cancel the test ride scheduled without assigning any reason.
The dates, if scheduled, are not contractual commitments and may be changed or rescheduled by the dealership at its sole discretion.
The prices displayed on the website at the time of booking are subject to change. Chetak Technology Ltd./Bajaj Auto Ltd. or its dealerships may run schemes at select locations, for specific periods, for special products etc., customer shall verify the eligibility / applicability of the scheme with the respective dealership. The terms and conditions specified time to time for any such schemes, are applicable.
Customer may make the balance payment online or directly to the selected dealership as applicable on the date and time of the invoice. Balance payment receivable is on-road price post deduction of booking amount paid and finance amount adjusted for the amount approved / received from the financer.
If customer applies for finance through any offline financers, customer shall submit the finance sanction letter directly to selected dealership, upon receipt of approval at dealership, customer shall make the final payment online or directly to dealership.
The final invoice shall reflect the actual prices/ charges as on the date of the invoice i.e. the ex-showroom price, the insurance charges, the finance charges (for loan, if any), the applicable RTO registration, smart card charges, Govt. subsidies (implicit or explicit), if applicable, handling charges or other optional costs and their respective taxes.
The final invoice will be generated by the dealership upon receipt of the final nett payment equal to on-road price of the vehicle. customer shall make the payment for any differential amount arising due to revision in vehicle prices or any other extra-ordinary, unforeseen and unavoidable circumstances.
Any difference between amount paid by customer and amount invoiced by Dealership through the final invoice shall be made good by the customer or the Dealership, as the case may be. The amount mentioned on the final invoice shall be treated as final and the Dealership shall reserve the right to deliver the vehicle only upon receipt of the final nett payment as per final invoice.
CTL/BAL reserves the right to make changes in the product, including the withdrawal of a product from the market, without prior intimation to the Customer. The customer is free to change his/her selection to any other available product at the selected dealership, or cancel the booking.
The Central Govt. subsidy (FAME-II / EMPS-2024, as applicable) benefits, if any, as applicable for an eligible vehicle and/or eligible customer, as submitted and claimed by Chetak Technology Limited / Bajaj Auto Limited or its authorized dealership, as per respective government guidelines, shall be adjusted at the time of customer invoice, subject to receipt of approvals from respective government departments.
The customer shall provide an undertaking with regard to eligibility towards Central Govt. subsidy (FAME-II / EMPS-2024, as applicable) and declare upfront on his eligibility for subsidy as part of the documents for sale. Further the customer shall comply with the requirements of subsidy such as OTP verification of Aadhaar linked phone number and any other requirements as specified by Government of India / State Government for the purpose of subsidy. Failure to provide such documentation and required verification or rejection by the Government department of the said customer documentation shall result in removal of the subsidy amount in the sale price of the vehicle/ obligate the customer to refund the subsidy amount to the dealership.
Dealership has the right to reject the subsidy documents or take a no-interest refundable deposit against subsidy, refundable upon the approval of the subsidy by the respective government. Dealership has the right to demand payment of subsidy amount in full from the customer, in case the government rejects the subsidy and the dealership shall be entitled to receive the refund of the full subsidy amount from the customer. The government rejection against chassis number is adequate evidence of cause.
For the states where subsidies are to be claimed by the customer, the required documents shall be issued/provided by the Dealership during vehicle delivery and customer shall directly claim the benefits from the respective state government departments, as per the process defined by the respective State Government.
CTL/BAL may offer any add-on products, add-on services or service contracts (referred to as “add-ons”) to its customers during or after purchase of a vehicle. CTL/BAL shall reserve the right to withdraw any such add-ons without prior notice or amend the terms and conditions of such add-ons at any time. An add-on shall be voluntary to purchase or use by a Customer and is not mandatory. The Customer may agree to purchase/use such add-ons upon agreeing to the specific Terms and Conditions of the specific Add-on.
Add-ons offered on the website through authorised third-party partners, shall be subject to the applicable laws and terms and conditions of the respective third-party partners. Customer shall check and confirm any add-on products, add-on services or service contracts (referred to as “add-ons”) with dealership before making a booking/purchase. CTL/BAL shall not be liable for any deficiency in service or product or any other liability arising out of such add-ons offered by any third-party partners.
- Comply with instructions given in the User Manual and the Warranty Policy.
- Get the vehicle serviced/inspected at his own expense, by Chetak authorized service center or dealer.
- Only use genuine spare parts recommended by Chetak Technology Limited/Bajaj Auto Limited.
- In case of any concern / issues with the vehicle, the owner shall first contact Chetak authorized dealer/service center.
- On receipt of intimation from Chetak authorized dealer / service center, the owner shall make the vehicle available for periodic inspection and performance check and servicing. Any non-compliance of the aforesaid condition shall render the automatic extinguishment of the right of the owner to claim under warranty/extended warranty.
1. There is no liability in the matter of consequential loss or damage caused due to the failure of the parts, delay, if any, at the repairing workshop in carrying out repair to the vehicle shall not be a ground for extending the warranty period, nor shall it give any right to the customer for claiming any compensation for damages.
2. Dealer reserves the right either to repair or replace the defective part.
3. To avail Warranty / Extended Warranty benefits it is mandatory to maintain the vehicle as per the periodic maintenance schedule as eligible for the vehicle through Chetak Authorized dealer/service centre.
4. Failure to maintain the odometer / mileage recorder in working condition or disconnecting it or tampering with it will lead to refusal of claim.
5. The vehicles used for a competition or race and/or for attempting to set up any kind of record or for commercial purpose like Taxi or any other means of commercial transportation are not covered under warranty/extended warranty.
6. If any parts / assembly of the vehicle is tampered with, altered / replaced or repaired at the workshops other than authorized by Chetak.
7. The Warranty / Extended Warranty shall cease to operate in case of an accident on parts affected by the accident, once the parts are replaced with new one then warranty/extended warranty will continue till the warranty expiry period.
8. If vehicle breakdown happens and if it is not towed on flat bed it is against the policy and warranty will not be applicable for it.
1.1 Normal maintenance operations like brake, suspension and other minor adjustments.
1.2 Parts subjected to normal wear & tear like brake disc, brake pads, fork oil seal, bearings, motor oil seal, tires, auxiliary battery etc.
1.3 Any failure on vehicle onboard charger due to over voltage or any voltage fluctuations or no proper ground at charging place is not covered warranty/extended warranty
1.4 Replacement of rubber components like LH & RH handle grips, ‘O’ rings, bellows, fasteners, turn indicator rubber etc.
1.5 Replacement of electrical items like LH & RH switches, LED Headlight, brake light, turn indicator, for aesthetic appearance.
1.6 Painted parts:- Any defect arising out of external damages or due to usage of protective covers/additional protective coating, adverse atmospheric condition is not allowed.
1.7 Cost towards consumables like gear oil, fork oil, brake oil, grease etc. is borne by customer.
1.8 Any defect arising due to above consumables not changed as per schedule or if used other than the recommended one.
1.9 Damage to the motor, battery & any other item due to water entry while driving the vehicle through flooded roads or patches.
1.10 All chrome plated parts are prone to rust or corrosion in coastal area or in acidic environment or due to neglected cleaning etc.
1.11Oxidation of unpainted/painted parts in acidic environment or in a coastal area.
1.12 Normal service/maintenance activities including, but not limited to, change of gear oil or other fluids, tightening/adjustment of pedals, brakes, etc.
1.13 Any natural wear and tear, including without limitation ageing.
1.14 Parts of the vehicle that have been subjected to misuse, accident, negligent treatment or which have been used in conjunction with parts & an equipment not manufactured or recommended for use by Chetak Technology Limited.
1.15 Parts of the vehicle that have been altered and modified or replaced in unauthorized manner like use if wider tires, additional electrical load etc. and which in the sole judgement of Chetak Technology Limited affects its performance and reliability.
1.16 Vehicles which are not being inspected and serviced at recommended intervals in Chetak authorized dealers/service center as per the periodic maintenance schedule or which have not been operated or maintained in accordance with the instructions.
1.17 Any failure arising due to use of non-recommended battery charger.
1.18 Repairs and adjustments caused by improper maintenance, lack of required maintenance, or the misuse of electric components, other than the way it is specified in the Owner’s manual are not covered under warranty/extended warranty.
1.19 Damage due to accidents, acts of God like floods, earthquake and fires etc.
1.20 Cosmetic or surface corrosion from stone chips or scratches in the paint are not covered under warranty/extended warranty.
1.21 Use of non-genuine/non-recommended battery, charger, controller, motor, tyre, wheel rim or modification of the part.
1.22 Defects or damage caused by corrosion, overheating, freezing, abuse by the continued use of vehicle after a fault has become evident, or lack of timely servicing.
1.23 Defects caused by vandalism, riots, terrorism, intrusion of animals/insects, fire or by natural calamities including, but not limited to, waterlogging, floods, earthquakes, typhoons, or any other act of God.
1.24 Failure to maintain the odometer / mileage recorder in working condition or disconnecting it or tampering with it will lead to refusal of claim.
1.25 If any parts / assembly of the vehicle is tampered, altered / replaced or repaired at the workshops other than authorized dealers/service centers.
1.26 If vehicle breakdown happens and if it is not towed on flat bed, it is against the warranty policy and warranty/extended warranty will not be applicable in such cases.
After the online booking and payment has been completed, the transactions through the website are completed and further process for the vehicle registration, delivery and after sales service shall be carried out by the selected dealership.
CTL/BAL shall not be liable for any deficiency in service or product or any other liability arising after this stage or at the selected dealership.
The registration of the booked vehicle shall take place from an RTO associated with the dealership selected by the customer and the customer shall need to travel to the dealership premises at their own expense for verification of documents and delivery of the vehicle.
The obligation of providing/uploading acceptable local address proof for the purpose of registration through an RTO situated in the city of the dealership selected by the customer shall solely lie upon the customer. CTL/BAL and/or the selected Dealership are under no obligation to fulfil the sale of vehicle in the absence of complete and acceptable documents.
In the event of incomplete, incorrect or unacceptable documents uploaded / provided by the customer, CTL/BAL and/or the selected Dealership shall have the discretion to reserve their right to cancel the booking and retain Cancellation Charges to cover its inventory and/or any other administrative costs as incurred while processing the booking.
Customer shall have the obligation to produce acceptable and verifiable address proof (contact Dealership / see FAQ for list of acceptable documents) for registration at the time of submission. The customer acknowledges right of the Dealership to cancel the booking in the event that the documents are incomplete, incorrect or unacceptable for any other reason as may be specified.
The delivery of the vehicle booked via the online portal shall take place at the dealership premises as selected by the customer while booking the vehicle. The customer shall need to make their own arrangements at their own expense to take the delivery from the selected Dealership outlet.
Customer shall visit a dealership for delivery of the vehicle after receiving notification of the completion of registration and a communication from dealership about readiness of a vehicle for delivery. Whilst every attempt shall be made by dealership to adhere to a confirmed delivery schedule, the dealership at its sole convenience may reschedule delivery without assigning any reason for the same.
The promised delivery timeline, if any, of the vehicle booked via the website shall be the sole responsibility of the Dealership selected by the customer. CTL/BAL disclaims any liability arising out of any such change, advance or delay in the delivery timeline.
After sales service for a vehicle purchased is available at the dealerships listed on the website. To avail any after-sales service from the listed dealerships, the customer shall need to make their own arrangements at their own expense to reach the after sales facility of the dealership. All dealership offered after-sales facilities are within a radius of 7 km from the showroom of the listed dealerships. Customer shall be required to bring in the vehicle at their own expense to the dealership aftersales facility (service facility) to avail any after-sales service.
CTL/BAL might sell vehicles that might be considered Connected Vehicles as defined under the applicable policy and regulations of the Government of India and any guidelines issued thereunder. Such vehicles are fitted with a Machine to Machine (M2M) SIM. Any data collected by CTL/BAL from such vehicles shall be in compliance with the guidelines issued by the Government of India and amended from time to time.
The customer recognises that Chetak is a connected vehicle fitted with an M2M SIM as defined under the guidelines issued by the Government of India. As such, the vehicle shall be continuously transmitting machine related data through the M2M SIM.
In compliance with the Government guidelines for M2M Services, CTL/BAL along with its designated M2M Service Provider shall be storing the personally identifiable customer data such as registration & login data including but not limited to customer’s name, phone number, address, Vehicle VIN number. In the event of re-sale of such vehicle, the original Customer shall be required to inform CTL/BAL of the same (along with sharing KYC details of the new owner of the connected vehicle) in compliance with Government’s requirement to keep the M2M user database updated.
CTL/BAL and its successors, subsidiaries and affiliates, reserve their right to electronically collect and process any data transmitted by a connected vehicle in a continuous manner pertaining to the vehicle through direct and indirect means. Such data shall include, without limitation, technical and operating parameters & sensor data, riding conditions, time & location.
Such data shall be collected and used for the purpose of product development, bringing in improvements and identifying need for remedy on vehicle(s), if required, and also to ascertain compliance with warranty conditions during warranty period, including warranty/extended warranty, if offered.
The data may be stored / handled by authorized third parties of CTL/BAL in compliance with CTL/BAL’s Privacy Policy.
CTL/BAL shall comply with its Privacy Policy as agreed by customer during booking / sale of vehicle, subject to any data sharing compliance obligations as required by Government or regulatory authorities or as directed by any court of law.
CTL/BAL has the discretion to provide or restrict access to relevant data to the Customer through their Chetak App or limit / enhance the vehicle capabilities / performance basis the subscription. Such service shall be an Add-on service, available upon payment of applicable Data / tecpac Charges by the Customer. The Customer agrees and understands that such service may not be accurate at all times due to a variety of reasons (including but not limited to lack of availability of Data Network for real-time transmission of data, connectivity issues, technical issues etc).
The eligible models of Chetak are activated with TecPac for upto 1000 km / 30 days from the invoice date, as a trial pack, after which it will be de-activated, unless purchased. The TecPac can be purchased online at www.chetak.com, till one year from the invoice date, through payment of the subscription charges, as applicable on the date. Currently, The TecPac is provided with 5 year validity period. The TecPac charges / validity are subject to change without any prior notice. BAL/CTL reserves the right to withdraw or modify TecPac features / trial pack without any prior information.
The Customer accepts that subscription to any such add-on service is voluntary and that CTL/BAL shall not be liable for the accuracy or lack thereof of such service.
CTL/BAL reserves its right to withdraw or modify any subscriptions, Add-on service, trial pack, promotions, limited period offers etc., including the access to Chetak App and relevant data without any prior intimation. In the event that CTL/BAL withdraws such services, its liability shall be limited to pro-rated refund of the Data / tecpac Charges paid in advance by the customer for the period for which the customer is unable to avail such services, as approved and verified through dealership. There no liability on BAL/CTL in case of cancellation of trial pack/ promotions
In the event the Customer does not opt for the paid Add-on service, data / tecpac subscription, in those specific models of Chetak enabled with Bluetooth, the Customer may have access to limited information using Bluetooth connection with Vehicle through their Chetak App and the limited vehicle capabilities / performance.
It may be noted that neither the use of Chetak App (accessible through a Smart Phone with or without any add-on) nor the requirement of Data Network are integral part of Chetak Vehicle offering as applicable for the selected model as per the subscription status. The presence or absence of the Chetak App or the Data Network shall in no way impact the full and complete performance of any Chetak Vehicle. The Customer accepts that CTL/BAL shall not be responsible for the unavailability of the Chetak App or the absence of Data Network or any inaccuracy of data shared through the Chetak App and such situations shall not amount to deficiency in the services or product offered by CTL/BAL.
In the absence of Data network and/or subscription to data connection or Data related Add-on, services such as vehicle software check/validation and Vehicle Software Updates can be availed at Chetak Authorised Service Stations during scheduled service or as specifically instructed by the dealership or CTL/BAL, without additional charges up-to warranty period only.
CTL/BAL may also, at its sole discretion and where possible, as a means of reducing customer effort, push applicable software updates automatically, over the air (OTA) into the eligible vehicles for which the customer grants unconditional consent.
The customer may opt for a manual booking process at their preferred dealership. If the customer chooses a manual process of booking, no online entry would be possible for that transaction and all the process would be done manually at the selected dealership. All transactions would need to be conducted by the customer directly with the dealer without the assistance or use of the online system. No details of offline transactions between customer and dealership will be available for the customers using online platform.
For the Chetak model and all products sold through Chetak dealerships, only online booking is permitted and the customer is solely responsible for providing true and accurate information as well as valid address and identity proof documentation.
These terms and conditions shall apply on sale of all CTL/BAL products even if purchased offline.
If a vehicle is sold by the existing owner, the previous owner (or the customer who has resold his vehicle) shall inform the new owner to validate the purchase and get the KYC verified at nearest dealership, as mandated by department of telecom, Govt. of India. Dealership shall verify the documents, physical vehicle and verify the ownership transfer process. Until and unless KYC is completed and vehicle ownership is transferred to new owner, the previous owner retains the access to the features provided in chetak app, including vehicle tracking, trip details, vehicle history, etc. Bajaj Auto Ltd./Chetak Technology Ltd. or its dealerships shall not be responsible for any breach of information or data shared between the two parties (previous and new owner) or the unavailability of the Chetak App or the absence of Data Network or any inaccuracy of data shared through the Chetak App and such situations shall not amount to deficiency in the services or product offered by Bajaj Auto Ltd./Chetak Technology Ltd.
Any dispute arising out of a booking made via the website shall be dealt with according to CTL/BAL company policy. The courts at Pune, Maharashtra shall have the exclusive jurisdiction to deal with any dispute arising out of any transaction made via the website.
Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India.
The User hereby agrees to indemnify and hold harmless CTL/BAL, its affiliates, officers, directors, employees, consultants, licensors, agents and representatives from any and all claims, losses, damages, and/or costs (including reasonable attorney fees and costs) arising from (i) their access to or use of the website, Services or Products, (ii) violation of the Agreement, (iii) infringement, or infringement by any other user of their account with CTL/BAL, (iv) action or inaction on behalf of CTL/BAL’s third party affiliates, manufacturers, vendors, suppliers and logistic partners in providing services; and (v) infringement of any intellectual property or other right of any person or entity. CTL/BAL shall notify the user promptly of such claim, loss, liability, or demand, and in addition to the User’s foregoing obligations, the User agrees to provide CTL/BAL with reasonable assistance, at the User’s expense, in defending any such claim, loss, liability, damage or cost.
The User acknowledges and undertakes that they are accessing the website, the offered services and booking the products at their own risk and that they are using prudent judgment before placing an order for a product or availing any services through the website. CTL/BAL shall, at no point, be held liable or responsible for any representations or warranties in relation to the products. Refund of the booking amount towards the booking of a product shall be governed by the Refund Policy.
CTL/BAL does not provide or make any representation, warranty or guarantee, express or implied about the website, products or the services, and all implied warranties under law or contract are to the maximum extent possible hereby disclaimed.
The maximum aggregate liability of CTL/BAL, in respect of a product purchased via CTL/BAL’s website shall be limited to the cost of the product. The maximum aggregate liability of CTL/BAL in respect of any other transaction undertaken by the User by using the website shall be limited to the actual damages incurred, if any.
CTL/BAL disclaims any liability towards any third-party vendor products or services availed by the User through the website. The User shall have the sole responsibility to bear the liability, if any, arising out of any third-party services availed of by the User accessible via the website or outside of it.
Neither Party shall be considered in breach of this Agreement to the extent that performance of their respective obligations is prevented by Force Majeure Event that arises due to restriction imposed by the Government, Act of legislative or other authority, war situation , trade restriction by Government, unprecedented economic situation, civil commotion, explosions, epidemics, quarantine restrictions, strike, lockout or acts of God etc. , that affects the ability of a Party to perform its obligations as envisaged herein.
This website is controlled and operated by CTL/BAL. All material on this platform, including images, product details, dealership details, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. Material on the website is solely for the User’s personal, non-commercial use. The User must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and the User must not assist any other person to do so. Without the prior written consent of CTL/BAL, modification of the materials, use of the materials on any other platform or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which the User receives any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.
BAL may launch offers and promotions from time to time exclusively for Users of the App. Such Offer or Promotion shall be at the sole discretion of BAL and shall not be extended as a matter of right to a User. Mere purchase of a BAL vehicle shall not entitle any customer to such offer. It will be offered as per internal company decision.
Such offers and promotions will be made available to eligible users through the “Offer” section on the App
The terms and conditions of any such offer and/or promotion shall be at our sole discretion. We reserve the right to change them without specific notice.
The eligibility criteria for any such offers and promotions is an internal company decision and at the sole discretion of BAL. BAL is not obligated to disclose the same to the User or any other entity outside of BAL.
The eligibility criteria could vary from the model of the purchased vehicle, to the colour of the purchased vehicle or the state in which purchase has been made etc. The eligibility criteria shall be dynamic at the sole discretion of BAL.
The terms and conditions for availing the benefits under any Offer or Promotion shall be published on the Terms of Use, accessible through the App.
It shall be the duty of the User to stay updated with the terms of any offer or promotion as may be amended at the sole discretion of BAL. The applicable terms, as amended from time to time, shall always be accessible through the App and it is the duty of the User to check the same.
For extending the benefits to the users under any offer or promotion, BAL may engage with third-party services such as payment provider, SMS provider etc. Such third-party engagements shall be governed as per clause governing Third-Party services above.
Cash Back Offer
BAL may launch and run a Cash Back Offer. The terms governing such Cash Back Offer may be as under:
BAL may run the Cash Back Offer for a limited / defined period.
BAL has the sole discretion to change the terms and conditions of an ongoing Cash Back Offer at any point in time, may suspend the offer or completely stop the offer without being required to explain to or intimate the User.
The Cash Back Offer will be exclusively available to customers who are using the Chetak App, if they match the eligibility criteria as may be internally decided by BAL.
The Cash Back Offer shall be offered directly by BAL to the user. Any offers or discount given by the dealer are independent of the Cash Back Offer provided to a User of the App.
The Cash Back Offer shall be visible through the “Offer” tab on the App to eligible users.
The User will have to “Claim” the offer as per the instructions given on the App. The amount of Cash Back will be revealed to the eligible User and displayed on the screen once they claim the offer.
When the eligible User claims the offer, they will be provided a third-party URL link, either on their App screen or through an SMS or both, to submit their bank account details.
The third-party URL link will take the User outside the purview of the App and on to a web browser.
To remit the Cash Back, BAL will require the bank account details of the user. BAL shall then make the payment to eligible users through a third-party payment gateway.
The eligible user shall provide their bank details in which the cash back shall be remitted.
The User shall be solely responsible for ensuring accuracy of the bank account details provided by them and entered on the third-party payment gateway.
BAL or the third-party payment gateway provider shall not be liable for an error on the part of the user.
As such, BAL or the third-party payment gateway provider shall not entertain any requests to track the payment or the account in which the money has been remitted.
The Cash Back Offer shall be a one-time offer only, for each purchase. An eligible user who has availed the offer shall not be entitled for further Cash Back offers on the same vehicle purchase.
The Cash Back Offer may run for a fixed period. If an eligible user misses the timeline to avail the offer, they shall not be entitled to it after the time has lapsed. BAL shall not entertain any requests to extend the timeline.
The user shall be responsible for reading the terms & conditions of the third-party payment gateway provider and their privacy policy. BAL shall not be responsible for any transaction carried out using the third-party payment gateway provider.
The user availing the Cash Back Offer shall share their bank details at their sole risk and responsibility. BAL shall not be liable for any data breach or other issue arising out of the same.
After the bank account details are provided by the eligible User for availing the Cash Back, the mentioned amount of Cash Back shall be remitted by BAL through the third-party payment gateway provider. It may take up to 4 weeks for the amount to be remitted to the bank account of the User.
The eligible user can reach out to the Customer Support number provided in the App for assistance in availing the Cash Back Offer.
By consenting to these terms, the user agrees that they have read the Privacy Policy which governs the App and any offer/promotion offered through the App.
By consenting to these terms, the user gives consent to the data that may be collected for the purpose as may be specified in the Privacy Policy in order to enable BAL to provide the benefits under the offer/promotion.
